The Aged Care Quality and Safety Commissioner can make banning orders - which restrict individuals from giving any form of aged care - against anyone it finds has not complied with the Code of Conduct, is not suited to provide aged care, represents a risk to care recipient safety, has been convicted of an indictable offence involving fraud or dishonesty, or is an insolvent under administration.
Section 74GI of the Aged Care Quality and Safety Commission Act 2018 says the Commissioner must establish and maintain a Register of Banning Orders that lists particular information about the person who has been banned, including their name, ABN, details of the banning order, and if the ban has been revoked, among others.
The register, which was last updated on Friday, June 30, 2023, listed 46 names:
- NSW: 20
- ACT: 1
- VIC: 5
- QLD: 7
- SA: 9
- WA: 4
- NT: No entries
The Senior has chosen not to list any particulars about any one individual.
The register, and more information about it, can be found here.
